Artificial turf has developed to play a major role in recreation and team sports. It has become the surface of choice for public and some private playing fields. As it has grown in popularity it has improved in quality. The crumb rubber base has added more cushion and has been a great way to recycle tires, a win/win for all. Yet there have been lingering doubts about crumb rubber's chemical content and exposure to athletes of all ages. It even became the basis for a gender discrimination controversy in soccer.

On July 27, 2017, Crowell & Moring will be presenting a webinar hosted by the United States Fashion Industry Association on the hottest IP Supreme Court decisions from 2017 that will affect the fashion and retail industries.  Anne Li and Preetha Chakrabarti of Crowell will be discussing Star Athletica, LLC v. Varsity Brands, Inc. and Impression Prods., Inc. v. Lexmark Intl. Inc. The Star Athletica case involving the copyrightability of cheerleader uniform designs will have a significant impact on not only the fashion industry, but other industries that rely on copyright protection, such as consumer product manufacturing and 3D printing.  And the Lexmark decision involved the doctrine of patent exhaustion, and held that a patentee cannot sue for patent infringement after the first sale of a patented item, even if that first sale is outside the United States. Thus this case too will have an impact on any retailer that deals with IP and operations abroad.

We can all agree that 2016 was a crazy year, and so far 2017 is almost as bad. The record size of retail and manufacturer bankruptcies- Sports Authority, Sport Chalet, EMS, PSG/BAUER and now Gander Mountain had a heavy impact. The tug of war between brick and mortar and internet sales has been waking everyone up at night. The trade turmoil and administration change in Washington have rattled everyone’s cages. How do you guide a business based on consumer disposable income through this vortex? What can you do when California seems hell bent to make your life crazy with ridiculous regulations—and everyone else is copying them?

The members of the Sports, Fitness and High Tech Resource Group are here to help.  We have scores of lawyers with 20 or more years of experience representing the sports and fitness industry.  I just celebrated my 40th anniversary of the day that I, as a brand new lawyer, defended AMF Volt against a claim involving a falling chinning bar.
